Legalities vary from state to state

TRUTH #2

Driving with cannabis can be risky

TRUTH #3

There are multiple ways to travel safely

If you vacation in states (or countries) where cannabis is permitted, be aware of the laws in those locations. This may seem obvious, but it is important to resist the temptation to obtain products that contain the plant in locales without legal protections.

In some states, cannabis is legal for adult (recreational) use. In others, it is only legal for medical use, while it is illegal in some states altogether.

States with laws related to hemp-derived products add another layer of complexity. As of 2025, there are several of these, which has caused new legal gray areas.

You can find more information about the legal status of cannabis in each state on the website of the National Conference of State Legislatures.

Even if you are careful, there are still some potential risks associated driving with cannabis. For example, depending on location, you could be arrested for possession, even if it is legal in the place you are traveling to. Local laws may supersede state ordinances.

Beware! It is FEDERALLY ILLEGAL to transport cannabis across state lines!

The smell of burnt cannabis in public or in a moving vehicle can trigger unwanted attention from law enforcement. At best, you could be fined and have your cannabis confiscated. At worst, the police may arrest you.

Do not consume cannabis and drive. Use a rideshare, public transportation or other alternatives when traveling under the influence.

If you use cannabis on your journeys, you can reduce your risk of running afoul of local laws.

After visiting the dispensary, pack your product in a secure container that is not easily accessible in the vehicle. Many states require storing transported purchases in the back seat or trunk.

Never try to board a commercial airplane with cannabis in your bags or on your body.

Most overnight accommodations prohibit smoking because of clean air laws. Consider using infused edibles and beverages at during your stay. Better yet, patronize a cannabis-friendly lodging business that will welcome you!
